A. TERMS AND CONDITIONS

1. Scope
1.1 These Terms and Conditions (“T&C”) of Oliver Bindel, trading as “Oliver Bindel - Creative Services” (hereinafter "we/us"), apply to all contracts for the delivery of goods that you as a consumer or business customer (hereinafter "you") conclude with us regarding the goods presented by us on the online marketplace Spicerack Market (hereinafter "Spicerack").
1.2 The contract is concluded exclusively between you and us as the Seller. Spicerack acts solely as an intermediary platform and is not a contractual party.
1.3 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade or profession.
1.4 A business customer is any natural or legal person acting in the course of their commercial or professional activity.

2. Contract Formation
2.1 By listing an item on Spicerack, we make a binding offer to sell that item.
2.2 You can accept the offer via the ordering process provided on Spicerack. By completing the checkout process, you accept the offer and a contract is formed.
2.3 The contract text is stored and transmitted via the platform or email.
2.4 You are responsible for checking input errors before placing your order.
2.5 The contract language is English.

3. Right of Withdrawal
3.1 Consumers are entitled to a statutory right of withdrawal.
3.2 Further details are provided in the cancellation policy below.

4. Prices and Payment
4.1 Prices stated are total prices including applicable VAT.
4.2 Additional costs (e.g. shipping, customs duties, transfer fees) may apply and are borne by you.
4.3 Payment processing is carried out via payment service providers integrated into Spicerack (e.g. Stripe Connect, PayPal).
4.4 The Seller does not process payments directly.

5. Shipping and Delivery
5.1 Delivery is made to the shipping address provided during checkout on Spicerack.
5.2 If delivery fails due to reasons attributable to you, you shall bear the resulting costs.
5.3 For business customers, risk transfers upon handover to the carrier. For consumers, risk transfers upon delivery unless you arranged your own carrier.
5.4 We reserve the right to withdraw from the contract in case of incorrect or insufficient self-supply.

6. Retention of Title
We retain ownership of the goods until full payment has been received.

7. Warranty
Statutory warranty rights apply.
For business customers:

* We may choose the type of subsequent performance
* Warranty period may be limited to one year
* Warranty for used goods may be excluded
* Replacement does not restart limitation periods

7.2 These limitations do not apply in cases of:

* damages
* fraudulent concealment
* mandatory legal provisions

7.3 Legal recourse rights remain unaffected.

8. Custom Products
8.1 If products are customized based on your specifications, you must provide all required content and rights.
8.2 You are responsible for ensuring no third-party rights are violated.
8.3 You indemnify us against any third-party claims.

9. Applicable Law
German law applies excluding the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection laws remain unaffected.

10. Dispute Resolution
We are not obliged or willing to participate in dispute resolution proceedings.

B. PRIVACY POLICY

1. Data Collection
We collect personal data only as necessary to process orders and inquiries.

2. Contact
Data provided when contacting us will be used solely to process your request.

3. Order Processing
Personal data may be shared with shipping providers and payment providers where necessary.

4. Storage Duration
Data is stored only as long as required by law or for contract fulfillment.

5. Platform Responsibility
Spicerack may process additional data under its own privacy policy.

6. Your Rights
You have rights to access, correct, delete, and restrict processing of your data.

C. CANCELLATION POLICY

Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.

Withdrawal period
The withdrawal period is 14 days from the day you receive the goods.

Consequences of Withdrawal
We will refund all payments received within 14 days after receiving the withdrawal notice.
We may withhold the refund until goods are returned.

Return of Goods
You must return the goods within 14 days.
You bear return shipping costs.

Exclusion
No withdrawal right for custom-made or personalized products.
